Rural Toledo man faces multiple charges involving minors

A 51-year-old rural Toledo man faces a total of 11 sexual abuse charges involving minors and is being held in the Tama County Jail on $100,000 cash bond. Stewart David David Smith is accused of enticing or attempting to entice a minor with intent to commit sexual abuse and / or exploitation of that minor. Two of the charges involve children under age 16 and seven of the charges include children under age 13. Smith is also accused of two counts of indecent contact with a child for the purpose of arousing or satisfying his sexual desire. The alleged incidents occurred during the winter months of 2012-13 according to information filed by Tama County Deputy Sheriff Bruce Rhoads. Smith was earlier charged on May 6 with three of child endangerment / no injury in Tama County District Court, online records show. Court records show Smith was convicted of three counts of 1st degree sexual conduct in 1989.

Before Judge Paul D. Miller in Tama County District Court in Toledo. Mariah Elizabeth Moore, 39, Aplington, pled guilty to 1st offense drunken driving. She was fined $1,250, sentenced to two days in jail and directed to complete a substance abuse evaluation and follow through with any treatment recommendation. Moore was charged on Iowa Highway 21 on Jan. 16 by an Iowa State Trooper. Jacob Tod Rosenberger, 25, Tama, pled guilty to 1st offense drunken driving. He was fined $1,250 and is to serve two days in jail or complete an OWI weekend program within 150 days. Rosenberger was charged on March 9 in the 800 block of South Broadway by Toledo Police Officer Andrea Young. William Joseph Kelley, 39, Traer, pled guilty to simple domestic abuse assault. He was fined $65, sentence to two days in jail and directed to complete a Batterer’s Education Program. He was charged on March 15 with domestic abuse assault causing bruising by Tama County Deputy Sheriff Bruce Rhoads. Adam Blackcloud, 24, rural Tama pled guilty to 3rd offense possession of a controlled substance. A two-year prison term and $625 fine were suspended. He was placed on probation for two years to the Department of Correctional Services and directed to pay the enrollment fee. Court records state Blackcloud was charged after admitting to police officers he had smoked marijuana with friends in an apartment in the 100 block of North Broadway in Toledo. The charge was field by Toledo officer Jeremiah Mussman. Betty Jean Buffalo, 72, rural Tama, admitted violating terms of probation by failure to pay restitution, probation enrollment fee and failing to make probation appointments. She was found in contempt of court and sentenced to 45 days in jail with the sentence to begin in November. Buffalo may purge the contempt finding by making regular restitution payments of $50 monthly. She was originally charged in January, 2011, for writing 34 checks on a closed account to Casey’s General Store, Tama, totaling $1,017, and for writing 32 checks totaling $945 on a closed account to Casey’s General Store in Toledo. The incidents occurred in late December, 2009, and early January, 2010, according to court records. Tama and Toledo Police filed charges of 3rd degree theft to which she pled guilty to two counts.
