The wife of a passenger who later died from injuries suffered in a plane crash near Clutier on Nov. 28 has filed a suit alleging the wrongful death of her husband. The estate of the pilot of the plane, William S. Konicek Jr., is named as the defendant. Konicek was dead at the scene of the crash. The suit was filed on behalf of Susan Morrison individually and as executor of her husband Max Morrison’s estate on April 26 in Tama County District Court in Toledo. It seeks unspecified compensation for the injuries sustained before death, medical expenses and the loss of companionship. Max Morrison died on Jan. 7. The suit alleges negligence on the part of Konicek in the operation of the plane which struck power lines before crashing. In answer to the suit filed on May 9, the Konicek estate attorney, Jennifer Zahradnik, said William Konicek suffered a a fatal heart attack while flying the plane which resulted in the crash.
